Bunbury, Bunbury Central, South Bunbury & Bunbury Leschenault Rotary Clubs

1. The goods donated are offered for sale at a reserve price determined by Rotary in its absolute discretion.
2. Rotary is not obliged to disclose the reserve price.
3. Rotary has the right to withdraw the goods from sale at any time before Rotary accepts a bid for the goods at the Auction.
4. Rotary may refuse to accept any bid which, in its opinion, is not in the interest of Rotary.
5. In the event of there being any dispute of difference relating to the bidding or in the event that as a result of an inadvertent error or omission Rotary accept more than one bid for the same item, such item shall be sold to the high or highest bidder and any other bidder shall have no claim to the item or any other claim of any description howsoever arising.
6. In the event of there being any dispute or difference relating to the bidding Rotary has the power to determine the dispute and their decision is final and binding on the parties involved.
7. In the event of any dispute arising Rotary may reopen the bidding and may resubmit the item for sale by auction or alternatively tender.
8. Subject to the reserve price and the conditions stated here in the highest bidder shall be the purchaser.
9. If the successful bidder does not claim and pay for the items purchased by him within seven (7) days of the date of the Auction then Rotary shall be entitled to terminate the sale in its absolute discretion, without according the successful bidder notice thereof.
10. Only the goods donated by the supporters of Rotary Radio Auction are sold and the supporter donating the goods shall have no obligation to substitute other goods for the goods actually donated and sold or to pass credit in respect thereof.
11. Rotary is not liable for any non-supply or incomplete supply or other act or omission of a supplier of donated goods in the performance or delivery of donated services or goods. The successful bidder will be deemed to have agreed to indemnify Rotary from and against all and any liability suffered by the sucessful bidder and any other person in relation to loss and damage arising out of or in relation to the supply, non-supply, incomplete supply or other failure or default of a supplier of goods or services sold through the auction.
12. All bids are inclusive of GST.
